How Kevin Federline found out about Britney Spears’ pregnancy

Kevin Federline found out his ex-wife and the mother of two of his sons, Britney Spears, is expecting again like the rest of the world: on the internet.

“Kevin, like the rest of us, was made aware of her Instagram post,” the DJ’s family attorney, Mark Vincent Kaplan, tells Page Six exclusively.

Spears announced in her post Monday afternoon, “I got a pregnancy test … and uhhhhh well … I am having a baby.”

Her fiancé, Sam Asghari, later confirmed the news as well on his Instagram.

We’re told Federline, 44, did not call Spears, 40, after learning she is pregnant but did immediately connect with his high-powered lawyer.

“He and I spoke — I assumed I would be getting calls [from the media] and wanted to make sure I was saying something that was consistent with where he was at,” Kaplan says.

Federline congratulated Spears via his attorney Monday in a statement that said the former backup dancer “wishes [Spears] the best for a happy, healthy pregnancy and congratulates her and Sam Asghari as they plan for the excitement of parenthood together.”

Kaplan adds to Page Six, “Obviously when you have a happy co-parent, it’s the best thing for your children, so Kevin is wishing her a happy and healthy pregnancy, and he wanted to extend his congratulations to Britney and Sam Asghari, and they have a gain through the excitement of planning parenthood together.”

Federline was married to Spears from 2004 to 2007 and shares sons Sean Preston, 16, and Jayden James, 15, with the pop icon.

The exes currently have a 70-30 custody agreement in the father’s favor.

Kaplan says that arrangement is not expected to change much once Spears’ child with Asghari, 28, arrives, but it is a possibility.

“In California, custody is always modifiable any time during a minor child’s minority based on the best interest of a child,” he explains. “So the short answer is yes … if Britney wanted to [amend the arrangement]I’m sure something could be worked out.”

Kaplan notes, however, that Preston and Jayden are “teenagers now” — and although children do not decide what the custody order should be, “obviously we give a lot of weight to what their desires are.”

The family law expert said Spears will likely have to make “a lot of adjustments” once she gives birth, and if she would like to make changes to the order, “Kevin is always open to consider that based on what’s best for the kids. ”

Since Spears is now in full control of her finances following the termination of her nearly 14-year conservatorship in November 2021, it will be up to her how she manages funds for an additional child.

However, Kaplan says the child support the pop star pays for Preston and Jayden would not decrease because her order is based upon her being an “extraordinarily high-income earner.”

He points out, “The fact that she might have more expenses is not going to in any way be a factor that would a decrease in child support.”

Kaplan says child support continues until Spears’ sons are 18, at which point the boys will make their own arrangement with their mom.

The Grammy winner’s child with Asghari will be her third and the personal trainer-turned-actor’s first.

Meanwhile, Federline has four additional children from other relationships: 19-year-old daughter Kori and 17-year-old son Kaleb, whom he shares with ex-fiancée Shar Jackson, and 10-year-old daughter Jordan and 8-year- old daughter Peyton, whom he has with current wife Victoria Prince.
